The magistrates (judges are magistrates [CPC 808]) are either dishonest or ignorant of the definition of a "court of record". They wreak havoc as they ricochet about the crystal court room. They either do not know what a court of record is, or they arrogantly don't care. Since and before the time of Sir Blackstone (and affirmed by American courts) a court of record is defined in part as: "A judicial tribunal having attributes and exercising functions independently of the person of the magistrate designated generally to hold it."[Jones v. Jones, 188 Mo.App. 220, 175 S.W. 227, 229; Ex parte Gladhill, 8 Metc. Mass., 171, per Shaw, C.J. See, also, Ledwith v. Rosalsky, 244 N.Y. 406, 155 N.E. 688, 689][Black's Law Dictionary, Fourth Edition, 425, 426; see also 7 Cal Jur 571.] “MAGISTRATE. McLeod, 142 Fla. 254, 194 So. 628, 630.” Black's Law Dictionary, Fourth Edition, 1103 Each acts as if a judge were a tribunal in a court of record. With the power of the gun backing them up, they usurp the tribunal's authority, ignoring 1,000's of years of law precedent. With such judges on the bench, what hope is there for the future of America?
